App Terms of Use
1. About these terms
These terms apply to your use of the mobile and web applications provided by Intelligent Output Systems (Pty) Ltd (registration number 2012/209767/07), trading as IO Systems, including Connected Fleet, iBOS and iBOS Go, AgriERP and PersonAuth ("the applications"). By installing, signing in to or using the applications, you accept these terms.
Where your organisation has a written agreement with IO Systems for the applications, that agreement governs your organisation's use of them and takes precedence over these terms if the two conflict.
2. Your account
Your account is created by your organisation or by IO Systems on its behalf. Keep your sign-in details confidential, do not share your account, and tell your administrator or us at info@iosystems.co.za straight away if you believe someone else has accessed it.
3. Licence and acceptable use
IO Systems grants you a non-exclusive, non-transferable right to use the applications for your organisation's internal business purposes while your organisation's subscription or agreement is in force. The applications, including their software, design and content, remain the property of IO Systems or its licensors.
You may not copy, modify, reverse engineer, resell or sublicense the applications, use them for any unlawful purpose, try to gain unauthorised access to them or to the systems behind them, interfere with their operation, or introduce malicious code.
4. Your data and privacy
Data your organisation captures in the applications remains your organisation's data. Our App Privacy Policy, at iosystems.co.za/app-privacy-policy, explains how we handle personal information in the applications and forms part of these terms.
5. Availability and changes
We work to keep the applications available and secure, but we do not guarantee that they will be uninterrupted or free of errors. Service levels, where they apply, are set out in your organisation's agreement with us. We may update the applications from time to time to improve them, fix problems or meet legal and app store requirements.
6. Limitation of liability
To the maximum extent permitted by South African law, our total liability for any claim arising from your use of the applications, including any breach of our App Privacy Policy, shall not exceed the lesser of the total fees paid by you to us in the three (3) months preceding the claim, or R10,000 (ten thousand rand).
Nothing in these terms limits any liability that cannot lawfully be limited, or any right you have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or the Protection of Personal Information Act 4 of 2013 where those Acts apply. Where your organisation has a written agreement with us, the liability terms in that agreement apply instead.
7. Governing law
These terms are governed by the law of the Republic of South Africa, and the South African courts have exclusive jurisdiction over any dispute about them.
8. Changes and contact
We may update these terms from time to time, and the date at the top of the page shows when they last changed. Questions about these terms can be sent to info@iosystems.co.za or 087 943 6873, or by post to 4 Hurd Street, Newton Park, Gqeberha, 6045, South Africa.
